Marriage Registration
Every Nikah Registrar shall keep separate registers of marriages and divorces in the forms prescribed, and all entries in each such register shall be numbered in a consecutive series, with a new series beginning at the start of each year.
Marriage is defined as a lawful agreement under Muslim Law that binds a man and a woman, resulting in the validation of all rights and responsibilities, as well as the parties’ consent. Marriage is defined as a “civil nature contract.” However, Bangladesh has progressed toward secularism, with different marriage systems based on different religions. Regardless of religious norms for marriage in various religions, people of all faiths can simply register their marriage under the provisions of the Special Marriage Act, 1872.
Getting a license to get married
Anyone who wants to get married in New York State, no matter where they live, can apply for a marriage license in person at the Town Clerk’s Office in the Town of Hempstead. Both people who want to get married must sign the application for a license in front of a clerk. No one else can apply for the license on behalf of the couple who is getting married. Even if the person has been given Power of Attorney, this is still true. Signed marriage license affidavits that have been notarized cannot stand in place of the people getting married being there in person.
Proof of age and who you are
A person must show proof of age and identity by giving the issuing clerk one of the following documents that have to do with age. (All documents related to age must be originals, and documents from other countries must be translated into English and signed by a notary public):
- Baptismal Record
- Birth Certificate
- Census Record
- United States Naturalization Certificate
And one of the following documents that prove your identity (all documents that prove your identity must be original and valid):
- Driver’s License
- Employment Picture I.D.
- Immigration Record
- Passport
Previous Marriages
On the application for a marriage license, you must give information about any previous marriages. Applicants for a marriage license whose previous marriage(s) ended in divorce, annulment, or death of a spouse must show proof of dissolution of all previous marriage(s) by presenting a certified copy of Decree of Divorce or a Certificate of Dissolution of Marriage filed with a court of competent jurisdiction or a certified copy of Death Certificate for each previous marriage. This includes whether or not the former spouse or spouses are still alive and, if the applicants are divorced, when, where, and against whom the divorce or divorces were granted. All records about past marriages must be signed by a judge. There are no copies allowed.
Cost of a Marriage License
The $40 fee for a marriage license includes getting a Certificate of Marriage Registration. This certificate is sent to the applicants automatically 15 days after the officiant gets back the completed license (the person who performs the marriage ceremony). It lets people know that there is a record of the marriage.
Cash, a local check, or a money order made out to Kate Murray, Town Clerk, are all acceptable ways to pay.
If you want to pay for a marriage license with a credit card, it will cost you $41.55 plus a $1.55 fee to process the card.
Waiting Period
Even though the marriage license is given out right away, the wedding can’t happen within 24 hours of the time the license was given out. A Judge of the Nassau County Supreme Court or a Judge of the Nassau County Court can waive the 24-hour waiting period if both applicants are 16 or older. If either person is younger than 16, the order must come from a judge in the Nassau County Family Court.
License Validity
Most marriage licenses are good for 60 days, starting the day they are issued. People in the military who are on active duty and people in other extreme situations may be able to get a longer time on their marriage license. Couples can get out of the 24-hour waiting period by getting a waiver.
